Sipe’s family couldn’t be reached for comment Thursday. While he didn’t mention her by name, Mc. Auliffe took several shots at Rockingham County Commonwealth’s Attorney Marsha Garst during the press conference — essentially blaming her for misleading the jury. Garst declined to comment.“I cannot comment because this case can be litigated again,” she said after Mc. Auliffe’s decision. State Sen. Mark Obenshain, R- Rockingham, however, criticized the governor’s actions.“I know that any time that there is a decision to be made on a capital case, it is a tough decision,” said Obenshain, a Harrisonburg attorney. Auliffe’s reasons are not supported by law.“These [issues] have been litigated in no fewer than four courts and rejected at every turn,” he said.
